                         III. case Study Based Questions

Read the source given below and answer the questions that follows:
                            1. Manish bought a i-phone from his friend, who is an authorised dealer for `85,000. He
bought it without a bill but his friend guaranteed him one year warranty which says, in
case, within a year, if there is any defect in the phone, it will be replaced with a new one.
After 2 months, phone stopped working properly. Manish approached his friend to get his
phone replaced. But the dealer refused to do so.
                                (i) Manish did not ask for the bill while buying phone, what is the consequence of it?
Ans. When his phone stopped working and dealer refused to replace it, he cannot file a
complaint against him. For filing complaint bill is very important because it is a proof
that you have made that purchase.
(ii) State the responsibility as a consumer which Manish has violated? If he was an aware
and responsible customer, what would have been his next course of action after getting
                                   denial for replacing his phone?
Ans. He has violated the responsibility of insisting for cash memo while purchasing his
phone. If he was an aware and responsible customer, he would have asked for bill at
the time of purchase. If he had bill, he could have filed a complaint against the dealer
in consumer court and asked for the compensation.

                            2. Himesh after completing his graduation started working with a multinational company in
Delhi. But due to ill health of his parents he had to go back to his village. There he noticed
that the villagers were literate but ignorant about their rights. Many vegetable vendors were
using stones as weights to sell their vegetables. Some shopkeepers were selling food items
without having ‘FPO mark’. Villagers did not find anything wrong with these practices. So
to create awareness among villagers Himesh decided to publish a weekly Journal ‘Jan Jagriti’
